Legal and Judicial History

• On August 1, 2013, a larger bench of the High Court declared Jamaat-e-Islami "illegal" and canceled the registration granted by the Bangladesh Election Commission (EC).
• On October 28, 2018, the Election Commission canceled Jamaat’s registration based on that court ruling.
• In December 2016, the Supreme Court full bench issued an administrative order banning the use of the ‘Dariyapalla’ symbol by the public, political parties, or candidates, and declared the related administrative procedures obsolete.

 

🔁 Appellate Division and Restoration

• On November 19, 2023, Jamaat’s appeal was dismissed by default but was later revived.
• On October 22, 2024, the Appellate Division reinstated the case and began the judgment process.
• On June 1, 2025, the Appellate Division, led by Chief Justice Syed Refat Ahmed, overturned the High Court verdict and directed the Election Commission to resolve the matter of Jamaat’s registration and its ‘Dariyapalla’ symbol impartially.

 

🗓 Election Commission Actions

• On June 3, after discussions with Jamaat’s lawyers, the Commission was compelled to effectively resolve the case.
• On June 4, during the 6th Commission meeting, a policy decision was made to reinstate Jamaat’s registration and return the ‘Dariyapalla’ symbol. Commissioner Abul Fazal Md. Sanaullah stated that this symbol had been used during 2008–2013 and earlier, which was duly considered.

 

📜 June 24, 2025: Official Notification

• On June 24, a notification was issued, signed by EC Secretary Akhtar Ahmed, stating:
• Jamaat was registered on November 5, 2008, under Article 90B of the “Representation of the People Order, 1972” with registration number 14.
• The notification canceling registration on October 28, 2018, was revoked following the 2013 High Court ruling.
• The Appellate Division (Civil Appeal No. 139 of 2013 with CPL No. 3112 of 2013) overturned the High Court verdict and ordered reinstatement. As a result, Jamaat-e-Islami’s party registration and its ‘Dariyapalla’ symbol have been restored.
